After our company's investigation and evidence collection, some users have illegally obtained our company's developed software PHPDisk cloud storage system (Z-Core online earning network disk series, F-Core resource paid online earning system, E-Core enterprise office system, S-Core short URL online earning system, SP-Core niche space system) through cracking and illegal downloads from the internet for illegal distribution, use and extremely low-priced illegal sales. The circumstances are serious and severely damage the legitimate rights and interests of our company and other authorized users. Supporting genuine products, the country is strongly cracking down on copyright infringement. Our company has submitted a case report to relevant national departments, cooperating with user feedback on the internet, collecting and verifying relevant infringement evidence, investigating illegal distribution of our developed products, and investigating individuals, groups and companies suspected of cracking this software.

The related behavior of the incident has violated the relevant provisions of China's current "Copyright Law". To maintain all legal rights of this software, we hereby declare as follows:

China's current "Copyright Law" clearly stipulates: The crime of copyright infringement refers to the act of violating copyright management regulations, infringing on others' copyright without the permission of the copyright owner, for the purpose of profit, with a large amount of illegal gains or other serious circumstances.

Copyright Law Article 47

Those who commit the following infringements shall bear civil liability such as stopping the infringement, eliminating the impact, making an apology, and compensating for losses according to the circumstances:

  • (1) Publishing works without the permission of the copyright owner;
  • (2) Publishing works created in cooperation with others as one's own works without the permission of the co-authors;
  • (3) Signing one's name on others' works without participating in the creation, for the purpose of seeking personal fame and gain;
  • (4) Distorting or tampering with others' works;
  • (5) Plagiarizing others' works;
  • (6) Using works without the permission of the copyright owner, by means of exhibition, cinematographic production and similar methods, or by means of adaptation, translation, annotation, etc., except as otherwise provided in this law;
  • (7) Using others' works without paying remuneration as required;
  • (8) Renting works or audio-visual products without the permission of the copyright owner of cinematographic works and works created by similar methods, computer software, audio-visual recordings, or the right holder related to copyright, except as otherwise provided in this law;
  • (9) Using the layout design of books and periodicals published by publishers without their permission;
  • (10) Broadcasting or publicly transmitting live performances or recording performances without the permission of performers;
  • (11) Other acts that infringe copyright and rights related to copyright.

Copyright Law Article 48

Those who commit the following infringements shall bear civil liability such as stopping the infringement, eliminating the impact, making an apology, and compensating for losses according to the circumstances; if public interests are harmed at the same time, the copyright administrative department may order to stop the infringement, confiscate illegal gains, confiscate and destroy infringing copies, and may impose fines; if the circumstances are serious, the copyright administrative department may also confiscate materials, tools, equipment, etc. mainly used to make infringing copies; if a crime is constituted, criminal liability shall be investigated according to law:

  • (1) Copying, distributing, performing, screening, broadcasting, compiling, or disseminating works to the public through information networks without the permission of the copyright owner, except as otherwise provided in this law;
  • (2) Publishing books for which others enjoy exclusive publishing rights;
  • (3) Copying, distributing audio-visual recordings containing performances, or disseminating performances to the public through information networks without the permission of performers, except as otherwise provided in this law;
  • (4) Copying, distributing, or disseminating audio-visual recordings to the public through information networks without the permission of audio-visual recording producers, except as otherwise provided in this law;
  • (5) Broadcasting or copying radio and television without permission, except as otherwise provided in this law;
  • (6) Intentionally circumventing or destroying technical measures taken by right holders to protect copyright or rights related to copyright for their works, audio-visual recordings, etc., without the permission of copyright owners or right holders related to copyright, except as otherwise provided by laws and administrative regulations;
  • (7) Intentionally deleting or altering electronic information of rights management of works, audio-visual recordings, etc., without the permission of copyright owners or right holders related to copyright, except as otherwise provided by laws and administrative regulations;
  • (8) Making or selling works with forged signatures of others.
Sentencing Range

Acts with a large amount of illegal gains or other serious circumstances shall be sentenced to imprisonment of not more than three years or criminal detention, and shall also, or shall only, be fined; acts with a huge amount of illegal gains or other particularly serious circumstances shall be sentenced to imprisonment of not less than three years but not more than seven years, and shall also be fined.

According to the above legal provisions, in order to maintain the legitimate rights and interests of the software, we will use the evidence from criminal investigation as evidence for civil compensation, the evidence collected by this website, and the evidence from users of this website, and take the fact that members of this website download and use the infringed software as notarization, and submit a complaint to relevant judicial inspection agencies.
